01Guangdong Promulgates Interim Measures for the Registration of Land Use Rights and Structures

(I) on the scope of registration.If it is clear that the right to the use of state-owned construction land is established on the ground, surface and underground of the land, it can be registered separately; it is stipulated that the right to the use of state-owned construction land on the ground and underground and the buildings (structures) on the ground can be registered in accordance with these measures. Not all above-ground and underground buildings and structures need to apply for registration of rights. Only when the land supply procedures for construction land have been completed, the ownership boundary is closed and has independent use value, the application for registration of rights has the meaning of property rights (meets the registration conditions).
(II) about how to register.The registration of the right to use the state-owned construction land on the ground and underground and the ownership of the buildings and structures attached to it should focus on five points.
(III) easement registration.In view of the fact that the foundations of above-ground buildings (structures) and the entrances and exits of underground buildings cannot obtain the right to use the surface, they may apply for easement registration to protect the rights and interests of the parties in accordance with the law.
(IV) split registration.Operating underground buildings (structures) may be divided and registered according to the basic units approved by the competent department of planning. Above-ground and underground mechanical parking lots (garages) and underground public parking lots shall be registered as a whole and cannot be divided into single parking spaces for registration.
(V) underground buildings shall be registered as houses.For underground buildings (structures) with a net height of more than 2.2 meters (inclusive), which are used for commercial, industrial, office, residential and other purposes, you can apply for the registration of house ownership. This provision is conducive to promoting the best use of underground buildings (structures) and safeguarding their capabilities.

● When the total proportion of the land area and the number of people who have signed a compensation agreement within the scope of the unit is not less than 95%, if the implementation subject and the person who has not signed the compensation agreement still fail to negotiate after full negotiation, in order to safeguard and enhance the public interest of the society, the municipal people's government may be requested to conduct mediation and adjudication in accordance with relevant regulations.
Each town street (park) plans a number of more than 500 mu of government co-ordinated "industrial reform" areas, the first phase of demolition within one year, all completed within three years, as the city's hard task.

1. Scope of application
These "Administrative Measures" are applicable to the construction of talent housing and affordable housing for urban renewal and land use projects in our city and their regulatory activities.
2. Management mechanism
Urban renewal and land bidding projects should adhere to six principles for the construction of talent housing and affordable housing: government enterprises, guidance and leadership, reasonable layout, facility sharing, relative concentration, and community integration.
3. Construction method
The specific construction method is selected by the regulatory body according to the actual situation of the project. The implementation subject should fully adopt the opinions of the regulatory subject on the layout of talent housing and affordable housing.
4. Requirements for construction
The talent housing and affordable housing should be designed, constructed and delivered simultaneously with the commercial housing of the project; if the project is constructed in stages, the talent housing and affordable housing should be arranged in the first phase in principle.
5. Construction handover process
The implementing entity applies for the transfer of the property after meeting the transfer conditions and transfer time agreed upon in the regulatory agreement. After on-site inspection and verification of the housing location, number of units, house type, housing quality and supporting facilities, the supervision subject shall sign a handover agreement with the implementation subject after collecting and filing relevant materials such as approval, construction, acceptance, completion drawings, instruction manual and quality warranty.
